Data Processing Agreement
GDPR compliance for data processing
This DPA implements GDPR requirements (Art. 28) for any processing of personal data that Macatuv does on behalf of its customers. The key points of this Agreement are:
Parties
"Controller" refers to the customer engaging Macatuv, and "Processor" is Macatuv.
Scope
Macatuv processes data only to provide the agreed-upon services (image analysis, product generation, license management).
Subject Matter/Purpose
Personal data may include images, names, emails, and other data for the purpose of delivering the Service (e.g. generating product descriptions, managing accounts).
Obligations
Macatuv will process data only on documented instructions from the Controller. We will maintain confidentiality, implement technical and organizational measures (e.g. encryption, access controls) to secure data (as required by GDPR Article 32). Macatuv will assist the Controller in responding to data subject rights requests, data breaches, and audits.
Sub-processors
We may engage subprocessors (e.g. AI service providers, hosting providers, Lemon Squeezy). We will inform you of any new subprocessor and ensure they also adhere to GDPR-level protections.
International Transfers
Personal data may be transferred outside the EEA (e.g. to the U.S.) to deliver the Service. We rely on approved safeguards (like EU Standard Contractual Clauses) to protect data in transit.
Duration
This DPA remains in effect while processing occurs. After termination of services, Macatuv will delete or return personal data (per our retention policy) unless retention is required by law.
Liability
Each party remains responsible for its own compliance. The Processor is liable for damages caused by breaches of data protection obligations.
Audit
Upon request, Macatuv will provide information to demonstrate compliance with this DPA and the GDPR.
Signatures
By using the Service, both parties agree to the terms of this DPA as part of the overall service agreement.
