Privacy Policy

How we collect, use, and protect your personal information

Introduction

Your privacy is important to Macatuv Ltd. ("Macatuv", "we", "us"). This Privacy Policy explains what personal data we collect from users of the Macatuv platform ("Service"), how we use and share that data, and your rights regarding your information. We are committed to complying with applicable privacy laws globally, including the EU General Data Protection Regulation (GDPR) and relevant US privacy laws. By using our Service, you consent to the practices described in this Policy. If you do not agree, please do not use the Service.

Data Controller: Macatuv Ltd., located at Arlozorov 80, Bat Yam, Israel, is the controller of personal data we collect in connection with the Service. You can contact us at info@macatuv.com for any questions or requests regarding your personal data.

Information We Collect

We may collect several types of information about you, including:

Information You Provide Directly

When you register for an account or contact us, you provide personal information such as your name, email address, password, and possibly company or website name. If you subscribe to a paid plan, you might provide billing information (payment card details, billing address) ; however, note that payments are handled via our third-party payment processor Lemon Squeezy, so we do not receive your full credit card details. We may also collect any personal information you include when contacting support or sending feedback.

Content and Usage Data

The Service involves you uploading or inputting content (like product images, descriptions, or prompts) and generating outputs. These user inputs and outputs may be stored on our systems. While typically this content is business-related (product data) and not personal data, it could incidentally include personal data. For example, if you upload an image or text that contains personal information, we will process and store it as part of providing the Service. All generated content (product descriptions, images, videos) is also stored so you can access it in your account. You own this content, as described in our Terms, and we treat it as confidential to your account.

Analytics Information

Macatuv uses analytics tools (such as Google Analytics) to collect information about how users interact with our website and app. This may include your IP address, browser type, device identifiers, pages visited, date/time of visit, and other usage statistics. We collect this to understand user engagement and improve our Service. Where required by law, we will obtain your consent for analytics cookies (see our Cookie Policy). Note that even with IP anonymization, analytics data can be considered personal data under GDPR because analytics cookies use unique IDs to track users. We therefore treat this as personal data and handle it with care.

Cookies and Tracking Technologies

We use cookies and similar technologies on our website. Some are necessary for the site to function (e.g. login session cookies), and others are for analytics or preferences. For details on specific cookies and choices, see our Cookie Policy section below. Generally, cookies may collect information such as your login status, preferences, and analytics identifiers.

Information from Third Parties

If you interact with us on social media or via third-party integrations, those services may send us certain information. For example, if in the future we allow "Sign in with Google" or another platform, we would receive your name and email from that service (according to your consent with them). Also, if you make a purchase, Lemon Squeezy may send us confirmation of your payment and license status (e.g. that your email has purchased a plan, license key validity). We may also receive basic technical data from our cloud hosting providers necessary for running the Service.

We do not knowingly collect any sensitive personal data (such as government IDs, health information, biometric data, etc.), and we ask that you do not provide such data in using our Service. The Service is not intended to process any special categories of personal data.

How We Use Your Information

Macatuv uses the collected information for the following purposes:

  • To Provide and Maintain the Service: We use your personal information to create and manage your account, authenticate you when you log in, and provide you the features of our platform (e.g. generating product descriptions from your inputs). The content you provide and generate is processed to deliver results to you and to save them in your account for your future access.
  • Transaction Processing: If you make a purchase or subscribe, we use your information to process the transaction (through Lemon Squeezy) and to manage license activation or subscription status. For instance, we may validate license keys via Lemon Squeezy's API. Your email and transaction ID might be used to apply the correct plan to your account.
  • Communications: We may use your contact information (email) to send service-related communications: confirmations, invoices, technical or security alerts, and important account or policy updates. We may also send you newsletters or product updates if you have opted-in to such communications. You can opt out of marketing emails at any time by using the unsubscribe link or contacting us.
  • Improvement and Analytics: We use usage data and analytics to understand how our Service is used. For example, we analyze which features are most used, how users navigate our interface, and where they encounter errors. This helps us improve our platform's functionality and user experience.
  • Personalization: To the extent we offer customizable features, we might use information like your preferences, past usage, or selected settings to personalize your experience. For instance, remembering your preferred language or the last project you worked on.
  • Enforcing Terms and Legal Compliance: We may process personal data to prevent misuse of our Service and enforce our Terms of Use. For example, we might review logs or content if we suspect violation of our policies (such as abusive or illegal content generation).
  • Protecting Rights and Safety: Information may be used to protect the rights, property, or safety of Macatuv, our users, or the public. This includes detecting and preventing fraud, security incidents, or other harmful activities.

We will only use your personal data for the purposes above and will not further process it in a manner incompatible with those purposes. If we intend to use your data for a new purpose, we will update this Privacy Policy and, if required by law, obtain your consent.

Sharing of Information

We treat your personal data with care and do not sell it to third parties. However, we do share information in certain circumstances:

Service Providers (Processors)

We share data with third-party vendors who perform services on our behalf, in order to run Macatuv. This includes:

  • Payment and Licensing: We use Lemon Squeezy for payment processing and license management. When you make a purchase, you are actually providing information (name, email, payment details) to Lemon Squeezy. They process the payment and share with us the outcome (paid or not) and relevant details like your license or subscription status.
  • Analytics: Google Analytics (provided by Google LLC) processes analytics data for us. Google acts as a data processor for this purpose, and we have accepted the Google Data Processing Amendment in our Google Analytics settings.
  • Hosting and Infrastructure: Our platform is hosted on secure servers (e.g., AWS or another cloud provider). These providers may process stored data (including your personal data and content) for storage and backup. They are not allowed to access your data except as needed for hosting services and are bound by confidentiality.
  • Email/Communication Tools: If we use an email service (like SendGrid, Mailchimp, or similar) to send newsletters or transactional emails, your name and email address will be shared with that provider solely for sending emails to you.

Legal Compliance and Protection

We may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with legal obligations (e.g., a subpoena, court order, or government request). We may also disclose data when we believe it's necessary to protect our rights or property, protect your safety or the safety of others, investigate fraud, or respond to a government request.

With Your Consent

In cases where you have explicitly consented to additional sharing of your information, we will share it as instructed. For instance, if we introduce partner integrations or an app marketplace, we will only share your data with those partners if you opt-in and authorize us to do so.

International Data Transfers

Macatuv is based in Israel, and we serve users around the world, including the United States and European Union. Data Location: Your personal data may be stored and processed on servers located in several countries. Primarily, data will be stored in Israel or specify primary server location. However, the use of third-party services (Google, Lemon Squeezy, etc.) means some data may be transferred to or accessed from the United States or other countries.

Israel Adequacy: The EU has recognized Israel's data protection laws as providing adequate protection for personal data, which means personal data can flow from the EU to Israel freely under GDPR. Macatuv being in Israel benefits from this adequacy decision. We handle data in accordance with Israeli privacy law as well as GDPR standards.

Transfers to Third Countries: When we transfer personal data from the EEA/UK/Switzerland to countries not deemed adequate (such as the US), we rely on appropriate safeguards. Typically, this means we have Standard Contractual Clauses (SCCs) in place with our service providers, or they are certified under frameworks like the EU-US Data Privacy Framework if applicable.

Data Retention

We retain personal data for as long as necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by law. This means:

  • Account Information: We keep your profile information (name, email, etc.) for as long as your account is active. If you delete your account or request deletion, we will remove or anonymize your personal data within a reasonable time after fulfilling any obligations.
  • Generated Content: Content you generated (descriptions, images) and any data in your account will typically be retained while you have an account so that you can access your past projects. If you delete a specific content item or your account, the data may still exist in backups or archives for a limited duration before permanent deletion.
  • Transaction Records: We will retain records of purchases, payments, licenses, and related communications as long as needed for accounting, auditing, and compliance with consumer protection and financial regulations.
  • Analytics Data: Analytics and web log data are retained as long as necessary for analysis. Google Analytics data retention is typically set to 14 months by default, but we may adjust that setting.

Data Security

Macatuv takes the security of your data seriously. We implement technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Encryption: All communications between your browser and our Service are encrypted via HTTPS/TLS. Sensitive data (such as passwords) is stored hashed or encrypted in our database.
  • Access Controls: Only authorized personnel and contractors who need to know your information to operate, develop, or improve our Service have access to personal data, and they are bound by strict confidentiality obligations.
  • Network & System Security: We maintain firewalls and monitoring to protect our network. Regular security updates and patches are applied to our software and systems to address vulnerabilities.
  • Testing and Audit: We periodically review our information collection, storage, and processing practices, including physical security measures, to guard against unauthorized access.

No system is 100% secure, so we cannot guarantee absolute security of information. You also play a role in keeping your data secure by maintaining a strong password and not sharing it. If you believe your account or data may have been compromised, please contact us immediately.

Your Rights and Choices

Depending on your jurisdiction and subject to applicable law, you have certain rights regarding your personal data. These rights may include:

  • Access: You have the right to request a copy of the personal data we hold about you. We will provide this information, usually within 30 days, as required by law.
  • Rectification: If any personal information we have is incorrect or incomplete, you have the right to request correction. You can update some of your profile information directly in your account settings, or contact us to correct or update your data.
  • Erasure: You may request that we delete your personal data. This is sometimes called the "right to be forgotten." We will honor deletion requests to the extent required by law.
  • Data Portability: You have the right to request your personal data in a structured, commonly used, machine-readable format, and to have us transmit that data to another controller where technically feasible.
  • Restriction of Processing: You can ask us to restrict the processing of your personal data in certain circumstances (for example, if you contest the accuracy of the data).
  • Objection to Processing: If we are processing your data based on our legitimate interests or for direct marketing, you have the right to object to that processing.
  • Withdraw Consent: Where we rely on your consent to process data (for instance, for sending marketing communications or setting non-essential cookies), you have the right to withdraw that consent at any time.

To exercise any of your rights, please contact us at privacy@macatuv.com or info@macatuv.com with your request. We may need to verify your identity before fulfilling certain requests to ensure that your data is protected from unauthorized access. We will respond to your request within the timeframe required by law.

Children's Privacy

Macatuv is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13 years of age (or under 16 in certain jurisdictions, such as the European Union, without parental consent). Our Service is intended for businesses and adults. If you are under the minimum age in your region, please do not use our Service or provide any personal data.

If we become aware that we have inadvertently collected personal data from a child below the applicable age, we will take steps to delete that information promptly. Parents or guardians who believe that Macatuv might have collected personal information from a child under the age of consent can contact us at privacy@macatuv.com, and we will delete the information.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we update the policy, we will revise the "Last updated" date at the top or bottom of this Policy. If the changes are significant, we will provide a more prominent notice, either by email (if we have your email on file) or by placing a notice on our website, prior to the change becoming effective, as required by applicable law.

We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information. Your continued use of the Service after any changes to this Policy constitutes your acceptance of the updated terms, to the extent permitted by law.
