Acceptance of Terms

By creating an account or using the Macatuv platform ("Service"), you agree to these Terms of Use ("Terms"). If you do not agree, you must not use the Service. These Terms form a binding agreement between you (an individual or entity) and Macatuv Ltd. ("Macatuv," "we," "us"). We may update the Terms periodically and will notify users by updating the "Last updated" date or via email. Continued use of the Service after changes means you accept the revised Terms.

Eligibility

You must be at least 13 years old (or 16 in the EU) to use Macatuv. If you are under 18, you affirm that you have your parent or guardian's permission. You must also have the legal capacity to enter a contract. Use of the Service is void where prohibited. We do not permit use by any user previously banned from our Service.

Account Registration and Security

To access certain features, you may need to create an account. You agree to provide accurate, current information during registration and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

Account Security: Use a strong, unique password and notify us immediately at info@macatuv.com of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

Subscriptions, Credits and Payments

Macatuv may offer its Service through subscription plans or credit-based packages (e.g. purchasing AI generation credits). Prices and details are described on our Pricing page. Payments are processed by third-party providers (such as Lemon Squeezy) on our behalf. By subscribing or buying credits, you authorize our payment processor to charge your provided payment method for the fees due.

Refunds: We offer a 14-day refund period for first-time purchases, only if you have not used any credits or AI generation services in that period. If you begin using credits or after 14 days have passed, the purchase is no longer eligible for refund (see our Refund Policy for details). You are responsible for any taxes or fees associated with the purchase. We reserve the right to change fees or introduce new charges with advance notice.

License to Use Our Service

Subject to your compliance with these Terms and payment of applicable fees, Macatuv grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Macatuv platform and its software solely for your personal or internal business purposes. This license allows you to use our web-based tools to generate product descriptions, images, and related content using our AI.

Restrictions: Except as expressly permitted by us, you agree not to: copy, modify, distribute, or create derivative works based on any part of our Service or software; rent, lease, or sell access to our Service; decompile or reverse engineer any software or feature (except as allowed by law); or use the Service in order to build a competing product or service. All rights not expressly granted to you are reserved by Macatuv and its licensors.

User Content and Intellectual Property

Your Content Inputs: You may upload or provide text, images, video, or other materials as input for the AI ("Input"). You represent and warrant that you have the necessary rights or permissions to provide the Input to the Service and that doing so will not violate any law or infringe any third-party rights (e.g. copyright, privacy).

Generated Output: Based on your Input, the Service will produce AI-generated outputs such as product descriptions, images, or videos ("Output").

Ownership: You retain ownership of your Input and, to the extent possible under law, you own all rights to the Output generated for you. Macatuv does not claim any ownership rights in your Input or Output; it remains your content. We assign to you any rights we may have in the Output, and you are free to use the Output for any legal purpose, including commercial use, without royalty or attribution to Macatuv.

Prohibited Uses

You agree not to misuse the Service. In particular, you shall not:

• Illegal Activities: Use the Service for any unlawful purpose, or to generate content that is illegal, obscene, defamatory, threatening, or that encourages illegal activities.
• Intellectual Property Infringement: Input any material or request output that infringes the copyrights, trademarks, or other IP rights of others.
• Personal Data Abuse: Input personal data about individuals without consent, especially sensitive personal data, unless you have legal rights to process such data.
• Malicious Use: Attempt to probe, scan, or test the vulnerability of our Service or networks; interfere with or disrupt the Service's integrity or performance; transmit viruses, malware, or any harmful code.
• Misrepresentation: Falsely imply that the content generated by the AI was created by a human or by Macatuv (you should disclose it is AI-generated if required).

We reserve the right to suspend or terminate accounts that engage in any of the above prohibited activities or otherwise violate these Terms.

AI-Generated Content Disclaimer

The core of our Service is to provide AI-generated product content (descriptions, images, videos). Quality and Accuracy: While we strive for high-quality results, you acknowledge that AI-generated content may not always be accurate, complete, or free of issues. The AI may occasionally produce incorrect statements, outdated information, or content that requires editing.

Use at Your Own Risk: You should not rely on AI Output as the sole source of truth. Always review and verify the Output's accuracy and appropriateness for your needs before using it publicly. Macatuv makes no guarantee that the Output will meet your expectations, be 100% unique, or be suitable for any particular purpose.

Termination

You may stop using Macatuv and/or delete your account at any time. If you wish to delete your account and data, please contact us at support@macatuv.com. We may retain certain transactional records as required by law or as outlined in our Privacy Policy.

Macatuv reserves the right to suspend or terminate your access to the Service (and/or disable or delete any content) at our discretion, with or without notice, if we believe you have violated these Terms, pose a security/legal risk, or for prolonged inactivity. Upon termination, your right to use the Service will cease, and we may delete your content from our active systems.

Disclaimer of Warranties

Service Provided "AS IS": Macatuv provides the Service and all generated content on an "as is" and "as available" basis, without any warranties of any kind. To the fullest extent permitted by law, we disclaim all express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content (including AI-generated output) will be accurate or reliable.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Macatuv or its directors, officers, employees, affiliates, or agents be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of (or inability to use) the Service or any Output, even if we have been advised of the possibility of such damages.

Cap on Liability: To the extent permitted by law, Macatuv's total cumulative liability for any claims arising from or relating to the Service or these Terms will not exceed the amount you paid to Macatuv in the 6 months immediately preceding the event giving rise to the claim (or $100 if no fees were paid).

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles. Jurisdiction: You agree that any dispute or claim arising out of or in connection with these Terms or the Service shall be brought exclusively in the competent courts located in Tel Aviv, Israel, and you hereby consent to the personal jurisdiction of those courts.
